Terms of Use
Last updated: 7 November 2026
1. Who we are and what these terms cover
Hemmia is offered by Andreas Kalkum, Burgstrasse 21, 5634 Merenschwand, Switzerland, email [email protected] ("we", "us").
These terms apply to:
- the Hemmia app for iPhone (and later other phones) ("the app");
- the Hemmia hub software as we distribute it, as a Mac package or Docker image ("the hub");
- Hemmia Connect, our relay that lets phones reach a hub from anywhere, and the notifications we deliver through it ("Connect");
- the update service, which tells hubs about new versions;
together "Hemmia". By using Hemmia you agree to these terms. Our Privacy Policy explains how we handle data; it is not part of this agreement, but you should read it.
The app is distributed through Apple's App Store. Apple's Licensed Application End User License Agreement (the "Apple EULA") also applies to the app. These terms add to it. If the two conflict, these terms apply, except where the Apple EULA or section 12 requires otherwise.
2. Who may use Hemmia
You must be at least 13 years old to use the app. If you are under 18, or under the age of majority where you live, you need the permission of a parent or guardian. On a hub, the person who runs it (the "admin") decides who gets an account and is responsible for how children use it. If you use the app on its own with an AI provider, that provider's age rules apply too.
3. Your licence
The app: we give you a personal, non-exclusive, non-transferable licence, which we can revoke under section 9, to use the app on devices you own or control, for private, non-commercial purposes, in line with these terms and the Apple EULA.
The hub software: Hemmia's source code is licensed under the GNU Affero General Public License, version 3 (AGPL-3.0), once it is published. Where you receive the hub under that licence, the licence governs your rights to use, study, change and share the software, and nothing in these terms restricts them. These terms govern our services (Connect, notifications, the update service) and the app.
The Hemmia name, the ghost logo and the design of this website and the app belong to us. Using them to suggest that something is made or endorsed by us, when it isn't, is not allowed.
4. Your hub is yours
When you run a hub, you run it on your own computer, under your own control:
- You are responsible for your hub: its operation, its security (keep it updated, keep your passphrase and recovery code safe), its backups, and the people you give accounts to. If your hub stores other people's data, for example your family's, you are responsible for that under the law that applies to you.
- Models, keys and providers are your choice. Models you download are licensed by their makers, under their own terms. If you add a cloud provider's key, your use of that provider is under your contract with them, and its costs are yours.
- Web search and other online features of the hub run from your computer and are subject to the terms of the services they use.
- Data loss: chats are encrypted with each person's passphrase. If both the passphrase and the recovery code are lost, nobody can open those chats, including us. Make backups (see the guides).
5. AI answers
Hemmia shows answers generated by AI models. These answers can be incomplete, outdated or simply wrong, and they can sound confident when they are wrong.
- Check anything important, especially facts, figures, dates and anything that affects your health, money, legal position or safety.
- Answers are not medical, legal, financial, tax or other professional advice. For decisions that matter, ask a qualified person.
- In an emergency, call the emergency services, not an app.
- You are responsible for what you do with an answer, and for what you share from it.
6. Fair use
You agree:
- not to use Hemmia to create, store or share unlawful content, in particular content that sexually exploits or abuses children, incites violence or hatred, or infringes other people's rights (for example personality, image or copyright);
- not to use Hemmia to harass, threaten, deceive or defraud anyone;
- to use Connect only to reach Hemmia from your devices: not to serve other websites, files or services through your hub's address, not to use it for phishing, malware or spam, and not to get around its limits (for example by registering many hubs);
- not to interfere with our services or other users, for example by overloading the relay, probing it for weaknesses without our agreement, or automated mass registration (if you find a security problem, please tell us: we are grateful for responsible reports);
- to comply with the law that applies to you.
7. Hemmia Connect
- What it is: an optional way to reach your hub from anywhere. The admin switches it on in the hub's settings. Your hub gets an address of the form
<random-id>.h.hemmia.app. The connection is encrypted from your phone to your hub; we can't read it (see the Privacy Policy). - Price: free during the beta. If Connect becomes a paid service (currently planned: €29 a year or €2.99 a month per hub, with 30 days free), we will tell admins in the hub at least 30 days before, and Connect will only continue for a hub if its admin chooses to buy it. Purchases would go through a payment provider that sells in its own name, under its own terms, which we will link to before you buy. Access from anywhere with Tailscale, which you set up yourself, stays free.
- Limits: each hub can pass up to 20 GB a month through the relay. When a hub reaches it, Connect pauses for that hub until the next month (counted in UTC). We may also pause Connect for everyone if the relay's own monthly traffic allowance is used up. Hubs remain reachable at home and over Tailscale.
- Versions: to protect everyone, Connect may refuse hubs running a version with a known security problem. The hub then tells its admin to update.
- Unused hubs: a hub's registration is deleted if it hasn't connected for 12 months. It gets a new address when Connect is switched on again.
8. Reporting abuse and illegal content
If you believe a hub address under hemmia.app is used to break these terms or the law, for example for phishing, please tell us at [email protected]. Include the address, what you saw and when. You may report anonymously, but then we cannot reply to you. We handle reports promptly, carefully and objectively; reports are reviewed by a person. Because connections through the relay are encrypted, we cannot see content. Where a report is credible, we may block the hub's address on the relay; we tell the admin why where we can reach them through the hub, and they can ask us to reconsider at the same address. In serious cases, especially where someone's life or safety may be at risk, please contact the police; where the law requires, we inform the authorities ourselves.
Point of contact under the EU Digital Services Act (Art. 11 and 12 DSA) for authorities and users: [email protected], in English, German, French or Italian.
9. Availability, changes and ending
- No guarantee of availability. We aim to keep Connect, notifications and the update service running, but cannot guarantee that they are always available or work on every network. Hemmia works at home without them.
- No entitlement to free services. We may change or end free features for the future.
- Changes to the app and the hub. We may improve and change Hemmia, for example to fix bugs, adapt to new operating systems, meet legal requirements or add features. Where a change would significantly affect something you have paid for, we will only make it for a valid reason, will tell you in good time, and will respect your statutory rights, including, in the EU, your right to end the contract under Art. 19 of Directive (EU) 2019/770.
- Ending Connect. If we ever plan to shut down Connect, we will announce it in the hub at least 60 days in advance; paid periods not yet used would be refunded pro rata.
- Your choice. You can stop using Hemmia at any time: switch Connect off or use Forget this address, and delete the app.
- Our choice. If you seriously or repeatedly break these terms, we may block your hub on the relay. Where reasonable, we will warn you first, and we will tell you the reason (see section 8).
10. Warranty and liability
We make Hemmia with care. If you are a consumer, the statutory warranty rights for digital content and services apply where you live, and nothing in these terms limits them.
We are liable without limitation for damage we cause intentionally or through gross negligence, for injury to life, body or health, and wherever liability is mandatory by law (for example under product liability law).
Otherwise: Hemmia, the app, the hub software and, during the beta, Connect are provided free of charge, and for features you use free of charge we are not liable for slight negligence. For paid features, we are liable for slight negligence only if we breach an obligation that is essential to the proper performance of the contract and that you may regularly rely on; in that case our liability is limited to the damage that is typical and foreseeable for this kind of contract. Beyond this, our liability for slight negligence is excluded, to the extent the law permits. These limits also apply to people who work for us.
We are not liable for the content of AI answers (section 5), for the models and services you choose (such as model makers, Anthropic, OpenAI, search engines or Tailscale), for how a hub is run by its admin, for data lost because a passphrase and recovery code were lost or no backup was made, or for services we do not control, such as Apple's App Store and notification service, your internet provider or your computer, unless we are responsible for the damage under the rules above.
If you culpably break these terms or the law while using Hemmia, and someone makes a claim against us because of it (for example because your hub's address was used for phishing), you must compensate us for the resulting damage, including reasonable legal defence costs. This does not apply if you are not at fault.
11. Third-party services
Hemmia works with services that other companies provide, including AI providers you choose, model makers, search engines, Apple's App Store and notification service, Tailscale and the payment provider for Connect. Their own terms and privacy policies apply to your use of them. We are not responsible for them, and their availability can change.
12. Apple-specific terms
These provisions apply because the app is distributed through the App Store:
- These terms are between you and us only, not with Apple. We, not Apple, are solely responsible for the app and its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app does not conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility, subject to section 10.
- We, not Apple, are responsible for addressing any claims by you or third parties relating to the app or your possession or use of it, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims arising under consumer protection, privacy or similar legislation.
- If a third party claims that the app or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must also comply with applicable third-party terms, such as those of your mobile network or internet provider, when using the app.
- Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
- Questions, complaints or claims about the app should be addressed to us using the contact details in section 1.
13. Changes to these terms
We may change these terms for the future if there is a valid reason (such as new legal requirements, new features or changes to how Hemmia works) and the change is reasonable for you. We will tell you about changes in the hub or the app at least 30 days before they take effect. If you don't agree, you can stop using our services before that date. Changes never affect payments made before they take effect.
14. Applicable law and courts
These terms are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer whose habitual residence is in the EU or another country, you also keep the protection of the mandatory consumer protection laws of that country.
If you are a consumer, you can bring proceedings in the courts of your place of residence or of our place of residence, and we can only bring proceedings against you in the courts of your place of residence (Art. 32 Swiss Civil Procedure Code; Art. 15–17 Lugano Convention; Art. 17–19 EU Regulation 1215/2012). For non-consumers, the courts at our place of residence in Switzerland have exclusive jurisdiction.
We would always rather sort things out directly, so please write to us first. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board or any other alternative dispute resolution body.
15. Final provisions
If any provision of these terms is or becomes invalid, the remaining provisions stay in effect, and the statutory provisions apply in place of the invalid one. These terms are written in English. A German translation is at hemmia.app/de/legal/terms/. If the two differ, the English version applies, unless mandatory consumer protection law provides otherwise.
